Prop 8 arguments at SCOTUS today

Here’s the best roundup of reactions in the legal fraternity and on a selection of media blogs/columns.

It hadn’t occurred to me till today, but there’s apparently a very real possibility that the Court could decide it doesn’t want to decide this at all just yet. From the “Plain English” summation of the arguments at SCOTUSBlog above: “the real question before the Court is not whether it would strike down Proposition 8, or what the broader effect of such a decision might be, but whether it is going to reach the merits of the case at all.”

That would mean the case would either be dismissed for lack of a majority on the Supreme Court or leave the District Court Prop 8 invalidation intact. This would probably not make either side happy.
